Terms and Conditions

1. Introduction and Definitions

These Terms and Conditions govern all pre orders, purchases, payments, deliveries, warranties, and customer obligations related to sofas marketed under the Sofa2Go brand and sold by iSmart Home.

“Sofa2Go” refers only to the brand and marketing presentation.

“iSmart Home” is the legal entity that accepts orders, receives payment, arranges delivery, and provides warranty service.

2. Pre Order Model for Teddy Sofa

All sales begin as a pre order. The current product price is 549 euros per unit.

To place a pre order the customer pays 99 euros at checkout. This amount represents a non refundable deposit equal to ten percent of the product price plus shipping.

After the pre order is confirmed the customer receives an email with a secure link to pay the remaining balance. The remaining balance must be paid within fifteen calendar days from the date of the pre order confirmation.

If the customer does not pay the remaining balance within fifteen days the order is cancelled automatically and the initial payment is not refunded.

3. Payment Terms and Title

Payment occurs in two steps. Step one is the initial 99 euros at pre order. Step two is the remaining balance via the payment link within fifteen days.

iSmart Home does not ship any product until the full price has been paid and confirmed.

Title to the product transfers to the customer only after full payment is received. Until then iSmart Home retains title.

4. Shipping and Delivery

Shipping begins after 20 December 2025. Any dates provided are good faith estimates and not guarantees.

Delivery time may be affected by courier capacity, customs, strikes, weather, or other events outside the control of iSmart Home. Such delays do not entitle the customer to a refund, discount, or compensation.

If the customer has not paid the remaining balance the order will not ship.

5. Inspection on Delivery and Risk

The customer must inspect the product upon delivery before signing the carrier receipt. Signing the receipt confirms the product was received in acceptable condition.

After acceptance any loss, damage, or deterioration is the responsibility of the customer. Claims for transit damage must be noted with the carrier at the time of delivery and reported to iSmart Home without delay.

6. Refunds, Returns, and Cancellations

The initial 99 euro payment is non refundable.

If the customer fails to pay the remaining balance within the fifteen day window no refund is issued.

No refund or return is offered for damage caused by misuse, mishandling, improper assembly, cuts, tears, stains, pet damage, exposure to heat or liquids, prolonged direct sunlight, or any condition outside normal household use.

Once the customer has accepted delivery by signature refunds and returns are not available except as required by mandatory consumer law.

7. Product Performance Policies

Seventy two Hour Rebound Guarantee. After unpacking, cushions will recover to approximately 95 to 98 percent of intended shape within 72 hours. This is normal expansion of high density foam and not a defect.

One Year Foam Warranty. iSmart Home warrants the high density foam for one year against collapse or manufacturing defects under normal household use. This warranty excludes damage from misuse, heavy point loads, improper maintenance, liquids, heat, or direct sunlight, and excludes normal softening or comfort preference.

8. Warranty Claims Process

For a warranty claim the customer must provide order number, photos or video of the issue, a description of household use, and proof of purchase.

iSmart Home may repair, replace like for like, or provide a reasonable remedy at its discretion. Remedies do not extend or renew the original warranty term.

9. Customer Responsibilities

The customer is responsible for measuring access routes and spaces including doors, stairs, elevators, and the intended room to ensure fit.

The customer must follow care instructions provided by iSmart Home. Failure to follow care instructions voids the warranty.

10. Limitation of Liability

To the maximum extent permitted by law iSmart Home is not liable for indirect or consequential loss including loss of profit, loss of opportunity, or inconvenience related to delivery timing or product use.

Total liability for any claim is limited to the amount paid for the product that gave rise to the claim.

11. Force Majeure

iSmart Home is not responsible for failure or delay caused by events beyond reasonable control including natural disasters, war, terrorism, labor disputes, utility failures, carrier disruptions, regulatory actions, or supplier shortages.

12. Anti Fraud and Order Review

iSmart Home may refuse, cancel, or refund any order suspected of fraud or abuse. If iSmart Home cancels an accepted order for reasons not attributable to the customer all amounts paid for that order will be refunded to the original payment method.

13. Communications

Order and payment updates are sent to the email address provided by the customer. The customer is responsible for maintaining an active email and checking spam or junk folders.

14. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the jurisdiction where iSmart Home is established and operates. Courts of that jurisdiction have exclusive competence unless mandatory consumer law states otherwise.

Nothing in these Terms and Conditions limits any non waivable consumer rights that apply by law.

15. Acceptance of Terms

By placing a pre order or purchase the customer confirms that they have read, understood, and accepted these Terms and Conditions.
